GENERAL TERMS AND CONDITIONS OF SALE OF THE “Pegna dal 1860” ONLINE SHOP

These General Terms and Conditions of Sale (“General Terms and Conditions”) govern the purchase of products offered on the e-commerce website pegna1860.mom (the “Website”), operated by:

Pegna dal 1860 complies with the regulations on distance contracts (Articles 49 et seq. of Italian Legislative Decree 206/2005 – the “Consumer Code”) and Italian Legislative Decree 70/2003 on e-commerce.
Customers are invited to read these General Terms and Conditions carefully and keep a copy on a durable medium. Submitting an Order implies full acceptance of these Terms.

Updates – These Terms may be amended at any time. New versions apply to orders placed after their publication on the Website.


1. PARTIES, DEFINITIONS AND SCOPE (B2C and B2B)

The products and prices published on the Website constitute an offer to the public pursuant to Article 1336 of the Italian Civil Code.
Sales are intended for both consumers (B2C) and professional/business customers (B2B).

  • Consumer: a natural person acting for purposes unrelated to their business, commercial, craft, or professional activity.

  • Business Customer (B2B): a natural or legal person acting in the course of their business.
    The consumer protections of the Consumer Code (e.g., right of withdrawal, conformity guarantee under Articles 128–135-bis) do not apply to Business Customers, unless otherwise mandatorily provided by law or expressly agreed in writing.

Pegna dal 1860 reserves the right to limit quantities per order or refuse orders that appear abnormal in relation to personal consumption or ordinary professional activity.

2. REGISTRATION AND DELIVERY SERVICES

Purchases may be made with or without registration. Available services:

  • National delivery via express couriers (DHL or equivalent: Bartolini/BRT, Poste Italiane).

  • International delivery via DHL or selected carriers.

  • Local delivery in central Florence via partners:

    • deluxy.it

  • In-store pickup: Via dello Studio 26R, Florence, during opening hours.

Availability, service areas, timing and costs are shown at checkout and may vary by destination, weight/volume, and carrier.


3. PRODUCTS AND VARIABLE-WEIGHT ITEMS

The assortment, features and prices may be updated at any time.
Images are for illustrative purposes: packaging may differ.

For variable-weight products (e.g., fruit & vegetables, cured meats, cheeses, deli), the actual weight is determined when preparing the order; the final amount is calculated on the actual weight, with any adjustment processed using the chosen payment method.


4. ORIGIN AND FOOD INFORMATION

Where required, the country of origin or rearing/slaughter is indicated. For fresh/seasonal products, multiple alternative origins may be listed based on availability.


5. PRICES, CHARGES AND PROMOTIONS

Prices are in Euro, including VAT (unless otherwise indicated for extra-EU B2B), and excluding shipping and ancillary services, which are calculated at checkout.
The price applied is the one displayed at the time of ordering. Promotions are for a limited time and may differ from those in the physical store.


6. ORDER ACCEPTANCE

The contract is concluded upon the order confirmation email sent by Pegna dal 1860.
Orders may be refused/cancelled in the event of: pricing/availability errors, unauthorised payments, logistical impediments, suspected fraud or abnormal use.


7. DELIVERY AND PICKUP

Lead times are indicative; delays due to force majeure/not attributable to the seller do not give rise to liability.
Local delivery via eco-friendly partners in central Florence.
In-store pickup: free of charge; the customer collects during the indicated hours.
In the event of absence/incorrect address, re-shipment/storage fees may be charged; perishable products may be charged.


8. UNAVAILABILITY AND SUBSTITUTIONS

If a product is unavailable, the customer will be contacted for an alternative/substitution or a refund of the relevant amount.


9. PAYMENTS

Accepted methods:

  • Credit/debit cards (Visa, Mastercard, American Express) enabled for online payments.

  • PayPal.

  • Any other methods made available by the Shopify platform and shown at checkout (excluding Satispay, not active).

Payment at checkout with possible pre-authorisation; the charge is made for the actual order amount (including variable-weight adjustments).


10. INVOICING (B2C and B2B)

  • B2C: invoices must be requested at the time of ordering.

  • B2B Italy: electronic invoicing via SDI; the customer must provide a VAT number and Recipient Code/PEC at checkout.

  • EU/extra-EU B2B and private customers: invoicing in accordance with the applicable VAT rules based on destination, VAT status and nature of goods.
    Requests/changes to invoicing details are not possible after order confirmation.


11. RIGHT OF WITHDRAWAL

Consumer (B2C): may withdraw within 14 days of receipt pursuant to Articles 52 et seq. of the Consumer Code, by notifying shop@pegna1860.mom. Returns at the customer’s expense; refund within 14 days of receipt of the goods in good condition.

Exclusions (Article 59 Consumer Code), including:

  • perishable goods or goods with a short expiry;

  • sealed goods not suitable for return for hygiene reasons if opened (e.g., opened food/beverages);

  • custom-made/personalised goods.

Business Customers (B2B): unless otherwise agreed in writing, do not benefit from the consumer right of withdrawal; the rules of the Italian Civil Code on contracts between professionals apply.


12. WARRANTIES

  • B2C: legal guarantee of conformity pursuant to Articles 128–135-bis of the Consumer Code, without prejudice to statutory exclusions for perishable food goods.

  • B2B: warranties under Articles 1490 et seq. of the Italian Civil Code apply, within the time limits and with the notification requirements set therein.


13. LIABILITY AND STORAGE

Pegna dal 1860 ensures compliance with the cold chain and proper storage up to delivery/pickup.
No liability is accepted for subsequent deterioration due to improper storage by the customer, nor for delays/inefficiencies attributable to carriers or force majeure.


14. ALCOHOL AND AGE RESTRICTIONS

The sale of alcoholic beverages is limited to customers who are 18 years of age or older. Pegna dal 1860 may request proof of identity and refuse delivery if in doubt.


15. PERSONAL DATA

Personal data are processed in compliance with Regulation (EU) 2016/679 (GDPR) and applicable national law. The up-to-date privacy notice is available on the Website.


16. APPLICABLE LAW AND JURISDICTION

The contract is governed by Italian law.
For Consumers, jurisdiction lies with the court of their place of residence/domicile (if in Italy).
For Business Customers, exclusive jurisdiction lies with the court of Florence, unless otherwise mandatorily provided or agreed.
